Starting with the 1st of January, 2011 every building offered for sale or rent will need to be accompanied by an Energy Performance Certificate obtained on the basis of an energy audit.

Starting when is the Energy Performance Certificate required?
Starting on January 1st, 2011, the development of Energy Performance Certificates and their availability to potential buyers or tenants insured by the owner becomes mandatory, if there are contracts regarding homes and apartments in residential buildings for sale - buy or rent. For all other buildings that are built or sold / rented, developing the energy performance certificate is mandatory since January 1, 2007. If existing buildings require thermal rehabilitation, the opportunity and necessity of thermal rehabilitation are presented through the Energy Audit. Both the Energy Performance Certificate and the Energy Audit are prepared by energy auditors for buildings, authorized by the Ministry of Regional Development and Housing and are valid for 10 years from the date of issue.
The certificate is prepared for the following new or existing buildings that are constructed, sold or rented:
- single-family homes;
- apartment buildings;
- offices;
- education building (nurseries, kindergartens, schools, colleges, universities, school hostels, boarding houses)
- hospitals, clinics;
- hotels and restaurants;
- gyms;
- trading services buildings (shops, retail spaces, firms, banks);
- other types of buildings (industrial buildings with normal operation);
Property owners are required to submit, upon sale or rental, an Energy Performance Certificate. For the categories of buildings that are being built, the presence of an Energy Performance Certificate falls under the care of the investor / owner and is included in the documentation for the build reception. Also, The Energy Performance Certificate is added to the technical file of the build, remaining in the possession of the owner until one is created. For buildings that are rented or sold, the certificate is being prepared by the care of the owner and is presented at the conclusion of the sale - purchase, or rental contract. The certificate is issued to the owner, who will present it to prospective buyers or tenants.
For buildings with a usable area of over 1000 square meters, owned / managed by public authorities or institutions providing public services, the certificate will be displayed in a public place and easily seen. Recommended internal temperatures will also be displayed in similar conditions.
