Starting with the 1st of January, 2011 every building offered for sale or rent will need to be accompanied by an Energy Performance Certificate obtained on the basis of an energy audit.

Legislation
The increasing price of fossil fuels, the depletion of natural resources, the economical situation of the country that must import oil and natural gas, the pressure on family budgets, the global greenhouse effect that has taken on worrying dimensions, applying to the measures adopted by the EU, all rank the increase of energy efficiency of civil buildings in the top of government concerns.
Starting January 1st, 2007 Law no. 372/2005 was introduced, regarding the energy performance of buildings, law that represents the transposing of Directive no. 2002/91/EC on energy performance of buildings and on February 21, 2007 Order no. 157/2007 of 01/02/2007 of the Ministry of Transport, Constructions and Tourism, was also introduced, it being an act that technically regulates the methodology for calculating the energy performance of buildings.
Under article 12 of this law: for all the categories of buildings that are built, the certificate is being prepared through care of the investor / owner and will be included in the documentation for the reception at the end of the build; also art. 13 provides as follows:
"The energy performance certificate of the building is being prepared in compliance with the legislation in force for the buildings stipulated in Article 7 (single-family homes, apartment buildings, offices, education buildings, hospitals, hotels and restaurants, gyms, building trade and services other types of buildings) that are being constructed, sold or rented."
So each home owner, in case he wants to sell or rent the home, will have to submit the Energy Performance Certificate of the building.
This certificate contains details concerning the energy efficiency of the building, which enable us to calculate the future costs for maintenance. Anyone that purchases a house or rents an apartment has the right to get informed about its heat performance.
The building's Energy Performance Certificate is issued by a certified energy auditor, following an energy expertise and is valid for ten years from the date of issue.
Through the National Program for Thermal Rehabilitation of residential buildings, the Romanian Government has established a legislative framework to encourage, facilitate and provide direct help for investments in the thermal rehabilitation of buildings.

- Order no. 691 of 10.08.2007 - regarding the approval of the methodological norms regarding energy performance of buildings published in M.O. Part I, no. 695 of 12.10.2007.
- Law no. 199/2000 - "Law of energy efficiency" for efficient use of energy.
- Romanian Government Ordinance no. 29/2000 – regarding the thermal rehabilitation of existing building fund and the stimulation of thermal energy saving (in accordance with the provisions of the Kyoto Protocol).
- Romanian Government Ordinance no. 174/2002 – regarding the establishment of special measures for the thermal rehabilitation of multi-storey residential buildings.
- Emergency Ordinance 18/2009 - on increasing the energy performance of housing blocks.
